Information includes methods of production, methods of processing (preparation), methods of of selling or other information in the fields of technology and/or business that is not known by the public and has economic value as it is useful in business activities, and the confidentiality of which is maintained by its owners. The owner has the rights to personally use his trade secret and to grant a license to other parties or to prohibit other parties to use his trade secret or to disclose the trade secret to any third party for commercial purposes.

Trade Secret is administered by Directorate of Copyright, Industrial Design, IC Layout and Trade Secret - Directorate General of Intellectual Property - Department of Laws and Human Rights, Republic of Indonesia.

Documents required for recording an assignment or  a license agreement of  Trade Secret in Indonesia :

 

1. Power of Attorney for trade secret to be simply signed by assignee / licensee;
2. Name and address of assignor and assignee;
3. Name and address of licensor and licensee;
4. State of Incorporation or Nationality of assignor and assignee;
5. State of Incorporation or Nationality of licensor and licensee;
6. Deed of assignment in English;
7. Deed of license agreement in English.
